On 9 December, TikTok and its parent company, ByteDance, filed an emergency motion for a temporary injunction to prevent a law that could ban the app in the U.S. starting 19 January. This action follows a federal appeals court’s unanimous dismissal of TikTok’s lawsuit challenging the law, which may require the app to sever ties with its China-based parent. The court emphasized the government’s focus on safeguarding American free speech from foreign influence.
In their motion, TikTok argued that the Supreme Court should have the opportunity to review this important case, suggesting that an injunction would allow the incoming administration time to assess its position. TikTok also noted the public interest in delaying the law’s enforcement until after the new president’s inauguration on 20 January.
The court previously raised concerns about Chinese laws that require companies to cooperate with state security, citing risks of espionage. While recognizing the potential impact on TikTok’s 170 million American users, the judges stated that the burden arises from perceived threats from the Chinese government. TikTok’s filing contended that delaying the law’s enforcement would enable a thorough Supreme Court review and give the new administration time to evaluate the situation before potentially shutting down a key platform for free speech in the U.S.

(7) Surge of AI-Enhanced Classic TV Drama Parodies on Mainland Internet Prompts Regulatory Action
The rise of artificial intelligence (“AI”) in China has recently led to a wave of parody adaptations of classic Chinese television dramas, which had since ignited significant debate. Humorous clips, such as one featuring Hua Fei racing on a motorcycle, have gained popularity online but have drawn criticism for disrespecting the original works and violating guidelines from the National Radio and Television Administration (“NRTA”).
Many viewers argue that these AI-modified clips trivialize the classic dramas, which hold important historical and cultural significance. Critics express concern that younger audiences, who may not be familiar with the originals, could misunderstand the source material.
In response, the NRTA has issued a notice addressing the issue, in which it stressed that such videos blur the line between parody and reality. The agency has called for regional authorities to monitor and remove these adaptations from video platforms to emphasize the need for clear labeling of AI-generated content in order to preserve the integrity of classic works.
